Terms of Use

These Terms of Use govern your access to and use of Keep in Touch and the associated website operated by Herb Trevathan ("we," "us," or "our"). By using the app or website, you agree to these Terms. If you do not agree, please do not use Keep in Touch.

1. App purpose

Keep in Touch is designed to help users stay connected with important people by managing contacts, notes, and reminders for personal or professional follow-up.

2. Eligibility and acceptable use

You may use Keep in Touch only in compliance with applicable law and these Terms. You agree not to misuse the app, interfere with its operation, attempt unauthorized access, or use the app in a way that violates the rights of others.

3. Free and paid features

Keep in Touch may offer a limited free tier and additional paid subscription features. Features, limits, and pricing may change over time.

4. Subscriptions and billing

Auto-renewable subscriptions may be offered through the Apple App Store or Google Play. Payment will be charged to your marketplace account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.

You can manage or cancel your subscription through your App Store or Google Play account settings. Refunds, billing issues, and renewal policies are generally handled by the marketplace provider.

5. Contact data and device permissions

The app may request access to features such as Contacts, Notifications, and Reminders when needed to support app functionality. You can manage those permissions in your device settings at any time.

6. Data storage

Keep in Touch is designed to store contact information, reminder schedules, and notes locally on your device unless you choose to share information through platform features. Your use of the app is also governed by our Privacy Policy.

7. Intellectual property

The Keep in Touch name, branding, website content, app design, images, videos, software, and related materials are owned by Herb Trevathan unless otherwise stated and are protected by applicable intellectual property laws.

8. No guarantee of outcomes

Keep in Touch is a reminder tool. It does not guarantee personal, social, professional, or business outcomes, and it does not guarantee that any reminder will always be delivered on time or without interruption.

9. Disclaimer

Keep in Touch is provided on an "as is" and "as available" basis to the fullest extent permitted by law. We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Herb Trevathan will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of data, goodwill, profits, or use arising out of or related to your use of the app, website, or marketplace subscription services.

11. Termination

We may limit or discontinue access to the app or website if required for maintenance, legal compliance, misuse prevention, or product changes. You may stop using the app at any time by uninstalling it and canceling any active subscription through Apple or Google.

12. Changes to these terms

We may update these Terms from time to time. Continued use of the app or website after changes become effective means you accept the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles.

If you downloaded the iOS version of Keep in Touch from the Apple App Store, Apple's Standard End User License Agreement may also apply: Apple Standard EULA.
